MIGA Qantas Rewards Program - Ts & Cs

1.  Introduction
1.1 These Terms and Conditions:
(a) set out Your contractual relationship with Us with respect to the Reward Scheme made available by Us as a participant in the Qantas Business Rewards Program or Qantas Frequent Flyer program;
(b) are effective as at the date specified above and may be amended from time to time; and
(c) operate in conjunction with the terms and conditions of the Qantas Business Rewards Program and the Qantas Frequent Flyer program and in the event of any inconsistency or conflict with these Terms and Conditions, the terms of the Qantas Business Rewards Program and Qantas Frequent Flyer program prevail. It is Your responsibility to read and understand the terms of the Qantas Business Rewards Program or Qantas Frequent Flyer Program, which Qantas may vary from time to time.

1.2 Any queries regarding these Terms and Conditions should be directed to Us.  Any queries regarding the terms of the Qantas Business Rewards Program or Qantas Frequent Flyer Program should be directed to Qantas.

 
2. Definitions
Unless the context otherwise requires:
(a) terms used in the Qantas Business Rewards Program or Qantas Frequent Flyer Program have the same meaning in these Terms and Conditions; and
(b) the following terms have these meanings in these Terms and Conditions.

Eligible Products means the medical indemnity insurance and professional indemnity insurance products identified in the Table.
Qantas Business Rewards Membership Account means Your membership of the Qantas Business Rewards Program.
Qantas Frequent Flyer Membership Account means Your membership of the Qantas Frequent Flyer Program.
Qantas Business Rewards Program means the business loyalty program that is currently known as the Qantas Business Rewards Program whether owned and/or operated by Qantas or any of its related bodies corporate.
Qantas Frequent Flyer Program means the loyalty program that is currently known as the Qantas Frequent Flyer program whether owned and/or operated by Qantas or any of its related bodies corporate.
Qantas Points means the loyalty points that are offered to Qantas Business Rewards Members or Qantas Frequent Flyer members for eligible purchases in accordance with these Terms and Conditions.
Reward Scheme means the MIGA Qantas Rewards Program which We and Qantas make available to You as set out in these Terms and Conditions.
Table means the table set out at the end of these Terms and Conditions
Terms and Conditions means the MIGA Qantas Rewards Program Terms and Conditions set out in this document and which We administer.
We, Us and Our means Medical Insurance Australia Pty Ltd.
You and Your means the person identified as the applicant in the application for the Reward Scheme.

2.2 In these Terms and Conditions, unless the contrary intention appears:
(a) the singular includes the plural and vice versa; and
(b) a reference to ‘include’ or ‘including’ means ‘including but not limited to’.
 
3. Binding agreement
By claiming any benefit under the Reward Scheme, You agree to be bound by these Terms and Conditions in addition to the terms of the Qantas Business Rewards Program or the Qantas Frequent Flyer Program.
 
4. Changes to the Reward Scheme
4.1 Subject to clause 4.2 and the terms of the Qantas Business Rewards Program or Qantas Frequent Flyer Program, We may implement any changes (whether material or otherwise) to these Terms and Conditions and the Qantas Points offered in relation to Eligible Products, including changes to:
(a) the ways in which Qantas Points are earned under the Reward Scheme;
(b) Eligible Products; and
(c) restrictions, conditions and eligibility to earn Qantas Points under the Reward Scheme.

4.2 We will inform You of material changes to these Terms and Conditions and, if a change will reduce the number of Qantas Points offered to You under the Reward Scheme, We will use reasonable endeavours to give you at least 30 days’ notice.

4.3 Without limiting clause 4.1 in any way, You will be taken to have received the notice referred to in clause 4.2 if We or Qantas notify You of the change by sending an email to the email address that You have provided to Us for the purpose of receiving communications about the Reward Scheme.
 
5. Termination or suspension of the Reward Scheme

5.1 We give no undertaking as to the continuing availability of the Reward Scheme. We may terminate or suspend the Reward Scheme at any time and will use reasonable endeavours to give You at least 30 days’ notice, except if the Qantas Business Rewards Program or Qantas Frequent Flyer Program cease to operate, in which case the Reward Scheme will cease immediately.

5.2 If We terminate or suspend the Reward Scheme, then, subject to the terms of the Qantas Business Rewards Program or Qantas Frequent Flyer Program, (where appropriate) You will be able to transfer Qantas Points during the notice period, except where we or Qantas have ceased to carry on business, have gone into liquidation, receivership or another form of administration, in which case Qantas Points in Qantas Business Rewards may be cancelled without notice to You.
 
6. Earning Qantas Points
6.1 You must be a Qantas Business Rewards Member or a Qantas Frequent Flyer Member to earn Qantas Points with Us.

6.2 Subject to this clause 6, We will instruct Qantas to award Qantas Points to You at the applicable rate specified in the Table, or in any special offer, for Eligible Products paid for by You.

6.3 No Qantas Points will be awarded if the Eligible Product is cancelled, refunded or returned.

6.4 You are not entitled to Qantas Points under the Reward Scheme for GST, government charges and taxes that apply to Eligible Products. Qantas Points are calculated after deducting any discounts, premium subsidies or rebates that apply to an Eligible Product.

6.5 To earn Qantas Points in relation to the Qantas Business Rewards Program, You must quote Your ABN at the time You apply for an Eligible Product and must comply with any other requirements or procedures advised by Us prior to Us agreeing to issue the Eligible Product.

6.6 To earn Qantas Points in relation to the Qantas Frequent Flyer Program, You must quote Your Qantas Frequent Flyer number at the time You apply for an Eligible Product and must comply with any other requirements or procedures advised by Us prior to Us agreeing to issue the Eligible Product.

6.7 It is Your responsibility to check whether a product or other activity is eligible to earn Qantas Points and, if so, how many Qantas Points or other benefits will be earned, before applying for an Eligible Product or undertaking the relevant activity.

6.8 You must provide Us on request with documented verification that we have issued an Eligible Product to You. We reserve the right to deny or revoke the crediting of Qantas Points at any time if We determine in Our absolute discretion that Qantas Points were improperly obtained or erroneously credited to Your Qantas Business Rewards Membership Account or Qantas Frequent Flyer Membership Account.

6.9 Unless otherwise determined by Us, You are not eligible to earn Qantas Points in the Reward Scheme if You are a business and your principal place of business is outside Australia.

6.10 We may offer additional opportunities to earn bonus Qantas Points under special promotions from time to time, in which case the terms and conditions referred to in the promotion will apply in addition to these Terms and Conditions.
 
7. Crediting Qantas Points
7.1 We will endeavour to instruct Qantas to credit the applicable number of Qantas Points to Your Qantas Business Rewards Membership Account or Qantas Frequent Flyer Membership Account as soon as practicable after Your payment for an Eligible Product and in any event within 30 days of payment by You.

7.2 If You are paying for an Eligible Product by instalments to MIGA, Qantas Points will be credited after each instalment payment and within 14 days of Your payment. 

7.3 It is Your responsibility to check that the correct number of Qantas Points have been credited to Your Qantas Business Rewards Membership Account or Qantas Frequent Flyer Membership Account.  

7.4 You may receive Qantas Points only in the Qantas Business Rewards Membership Account in the name of Your Business or Qantas Frequent Flyer Membership Account in Your name.

7.5 Claims for disputes in relation to the crediting of Qantas Points can only be made by You to Us within 90 days of the issue of an Eligible Product.

7.6 Despite clauses 6.5 and 6.6, We will credit Qantas Points retrospectively if You were not a Qantas member at the time You applied for an Eligible Product but You can only make a claim for retrospective crediting of Qantas Points within 7 days of payment by You for the Eligible Product by providing Us with Your ABN or Qantas Frequent Flyer Number, as applicable, and by complying with any other requirements or procedures advised by Us.

7.7 Unless otherwise specified by Qantas or by these Terms and Conditions, claims for the crediting of Qantas Points cannot be made if Your Qantas Business Rewards Membership Account or Qantas Frequent Flyer Membership Account is not current or if Your Qantas Business Rewards Membership Account or Qantas Frequent Flyer Membership was not active at the time the Eligible Product was issued.
 
8. Suspension or termination of Your entitlements

8.1 We reserve the right to terminate Your participation in the Reward Scheme or withhold or cancel Qantas Points claimed under the Reward Scheme if You or any of Your representatives have attempted to claim Qantas Points under the Reward Scheme to which You or they were not entitled.

8.2 Neither We nor Qantas will be liable for any loss or damage whatsoever suffered by any person as a result of such withholding or cancellation.

10. Acknowledgment and release
10.1 We recommend that You and, where applicable, your nominated Qantas Points recipients consult an accountant or tax adviser to understand possible tax (including fringe benefits tax) implications, if any, related to earning and using Qantas Points under the Reward Scheme.

10.2 You agree to release Us and Qantas from all liability, loss, damage and expense for or in relation to:
(a) taxes, charges, fees and other imposes of any kind levied, assessed, charged or collected in connection with the supply of any goods or services pursuant to the Reward Scheme; and
(b) any variation, suspension or termination of the Rewards Scheme,
and you acknowledge and agree that:
(c) We cannot guarantee that Qantas Points can be redeemed for any particular reward; and
(e) We make no warranties or guarantees in relation to the products or services offered or provided by Qantas; and
(f) We make no warranty as to the availability or quality of benefits for which Qantas Points may be redeemed through the Reward Scheme, and
(g) We are not responsible for any costs, liability or loss arising out of Qantas Points or other rewards earned or redeemed by You or others.

Qantas Points Earn Rate 1 Qantas Point per $1 paid to Us for an Eligible Product
The amount paid to Us is calculated on the total of the base premium and membership fee (where applicable) excluding GST but after any government rebate, subsidies and Risk Management Program discount and excluding government charges such as stamp duty and ROCS levy.
